AN ACT

RELATING TO CONSTRUCTION; PROHIBITING CODES AND RULES THAT REQUIRE PROVIDING ELECTRIC VEHICLE POWER TRANSFER INFRASTRUCTURE OR ELECTRIC-VEHICLE-CAPABLE PARKING SPACES IN RESIDENTIAL OR COMMERCIAL CONSTRUCTION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Construction Industries Licensing Act is enacted to read:

     "[NEW MATERIAL] BUILDING STANDARDS FOR INSTALLATION OF ELECTRIC VEHICLE POWER TRANSFER INFRASTRUCTURE--NO REQUIREMENT TO INSTALL.--

          A. The division shall establish minimum standards for the installation of individual electric vehicle supply equipment and the infrastructure required for the plug-in power transfer for an individual electric vehicle.

          B. Notwithstanding the provisions of Subsection A of this section, no standards or rules adopted pursuant to the Construction Industries Licensing Act shall require:

                (1) a specific or minimum number of required electric vehicle supply equipment spaces or electric vehicle capable spaces in a parking lot or parking structure;

                (2) the installation of infrastructure for plug-in power transfer for an electric vehicle in a residential construction project, a parking lot or a parking structure; or

                (3) a person to install infrastructure for plug-in power transfer for an electric vehicle or electric vehicle supply equipment or infrastructure in a residential or commercial construction project.

          C. As used in this section:

                (1) "electric vehicle capable space" means an automobile parking space provided with electrical infrastructure, including cables, electrical capacity, electrical distribution equipment space, enclosures and raceways necessary for connection to electric vehicle supply equipment; and

                (2) "electric vehicle supply equipment" means equipment for plug-in power transfer for a device, fitting, power outlet or apparatus installed specifically for the purpose of transferring energy between the premises wiring and an electric vehicle, including attachment plugs, electric vehicle connectors, equipment grounding, grounded or ungrounded conductors or a personal protection system."
